The Time is NOW for Legal Action – AAGLA Lawsuit Against LA County to Declare Eviction Moratorium Il

Date postedMarch 19, 2021
in Industry News,

Please help us to help you! The Pacific Legal Foundation, the Brennan Law Firm, and the Apartment Association of Greater Los Angeles are looking into filing a lawsuit against the County of Los Angeles to have a court declare the County’s extensions and expansion of its eviction moratorium illegal, as violations of recently passed Senate Bill 91’s preemptive language.

In order to do so, we are asking housing providers who have suffered direct damages as a result of the County’s non-rent eviction moratorium to contact us to determine whether their damages are sufficient to allow them to serve as a plaintiff in the lawsuit against the County. For example, an elderly property owner wants to terminate a tenancy and move into the rental unit due to her age and physical ailments. Unfortunately, under the County’s moratorium, the owner is not permitted to terminate the tenants’ tenancy, even though the owner’s physical health is at risk.

The Los Angeles County eviction moratorium governs in all unincorporated areas of the County and the County also claims jurisdiction over certain incorporated areas where local, incorporated jurisdictions do not have eviction moratoriums or have weaker eviction moratoriums than the County.

If you believe you have verifiable injuries or economic damages as a result of your inability to terminate a resident’s tenancy for reasons other than non-payment of rent, as a result of the County’s expanded eviction moratorium, we want to hear from you. Please email us with the following information to info@aagla.org:

  • Your name
  • Location of property at issue, including zip code.
  • Brief description of how you feel you have been harmed due to the County’s expanded eviction moratorium.
  • Best way to contact you: e.g., mobile phone, home phone, etc.
