AAGLA Obtains Further Legal Opinion on Anti-Price Gouging Law

10% Limitation on Rent Increases Under Governor’s Emergency Declaration Has Now Expired

Many attorneys, and as a result, many members have been under the impression that they may NOT to increase rent by more than 10% even following a vacancy due to the Governor’s emergency declaration impacting certain counties, including Los Angeles County, under the anti-price gouging laws. However, the Apartment Association of Greater Los Angeles has now obtained legal clarification that the Governor’s Executive Order on anti-price gouging and the section of California’s penal code limiting the right to increase rent by more than 10% actually expired on April 3, 2020. This option was further confirmed with the State’s legal counsel expiration of the Governor’s anti-price gouging order.
