New City of Los Angeles Notice Posting Requirement: Right to Counsel Program Ordinance
The City of Los Angeles has published the new, required notices for its Right to Counsel Program Ordinance (RTC).
The City’s RTC provides qualifying tenants with access to free legal representation in eviction and administrative proceedings that may result in the termination of tenancy or rental housing subsidy. Under the RTC, landlords in the City of Los Angeles are required to post the RTC notices at their properties and provide notices to tenants at various times informing them of their rights.
Specifically, landlords in the City of Los Angeles must now:
- Provide a Notice of Right to Counsel at the beginning of a tenancy in the tenant’s primary language; (ii) Attach a Notice of Right to Counsel to a copy of any eviction notice served on the tenant.
- Attach a Notice of Right to Counsel to any notice of termination of a rental housing subsidy (e.g., Section 8).
- Attach a Notice of Right to Counsel to any Section 8 administrative proceeding’s correspondence that may result in termination of the tenant’s rental housing subsidy.
- Post the Notice of Right to Counsel in a conspicuous common area of the residential building where the tenant resides.
In the event a landlord fails to fully comply with the RTC, an eligible tenant may assert as an affirmative defense to an eviction or administrative proceeding due to the failure to comply with any provision of the RTC. This new ordinance is effective as of August 25, 2025.
Notices for the RTC must be provided in the tenant's primary language. The City of Los Angeles has made the required notices available in the following languages: English, Spanish, Korean, Farsi, Armenian, Russian, Cantonese, Mandarin, and Tagalog.
