A. Application, Move-In & Move-Out

A.1 – Application to Rent

Use this form to obtain a prospective tenant’s information for evaluation.

A.1.1 – Applicant Rental Criteria

Provide this form to all rental applicants at the same time as you provide them with the rental application. This form is optional, but strongly suggested. Be sure to complete your chosen rental criteria on the form and be sure your criteria is consistent for all applicants. Do not discriminate.

A.2 – Deposit Receipt

Use this form when a tenant applicant provides a deposit prior to signing of a lease.

A.3 – Inventory Checklist – Premises Only

Use this form to document the condition of the rental unit at the time of move-in and later when a tenant moves-out. This form will assist you in documenting any deductions from a tenant’s security deposit.

A.4 – Notice of Negative Credit Information and Rental Application Rejection

Use this form to notify a tenant applicant of negative credit information and rejection of rental application.

A.5 – Pet Application

Use this form when tenant applicant has a pet that will live in the rental unit.

A.6 – Rental Unit Holding Deposit Agreement

Use this form when accepting a deposit payment to hold rental unit off of the market pending tenant applicant screening.

A.7 – Screening Fee Agreement

Use this form when accepting payment for credit check and background verification (tenant screening).

A.8 – Landlord Verification Form

Use this form to send to your tenant applicant’s prior landlord to verify information such as on-time rent payments, etc. The form must be signed by your prospective tenant to authorize the previous landlord to provide the information you are requesting.

A.9 – Notice of Tenant Credit Reporting (S.B. 1157) for Owners of 15 or More Assisted Housing Development Units

This form applies to owners of 15 or more “Assisted Housing Development” Units. On or after July 1, 2021 and until July 1, 2025 for new leases, and by October 1, 2021 for leases in existence as of July 1, 2021, landlords of one or more assisted housing developments (total of 15 or more units among all properties) must now offer tenants to have their rental payments reported to at least one consumer credit reporting agency. Landlords are required to offer tenants the option to have their rental payments reported annually after the initial offer if tenants do not initially elect to have their rent payments reported.
Landlords may charge any tenants that elects to have rent reported the lesser of $10.00 per month or the actual cost to the landlord to provide the service. If the fee remains unpaid for 30 days or more, the landlord may stop reporting the tenant’s rental payments and the tenant shall be unable to elect rent reporting again for a period of six months from the date on which the fee first became due.

A tenant who elects to have rent reported may file a written request to stop that reporting, provided that, the tenant is then prohibited from electing rent reporting again for at least 6 months thereafter. A tenant who elects to have rent reported does not forfeit specified tenant rights and if a tenant makes deductions from rent or otherwise withholds it, as authorized under the law, the deductions or withholding does not constitute a late rental payment.

An “Assisted Housing Development” means a multifamily rental housing development that receives governmental assistance under any of the programs set forth at: www.leginfo.legislature.ca.gov/sec.65863.10

B. Security Deposit

B.1 – Security Deposit Refund Form

Use this form to calculate the amount of security deposit to be refunded to a tenant. Attn. City of Los Angeles property owners: be sure to calculate interest due at published rates.

B.2 – Standard Security Deposit Agreement

Use this form to provide a tenant with the terms governing receipt and refund of a security deposit, and for tenant to acknowledge receipt of “house rules” and lack of security at premises, among other things.

B.3 – City of Los Angeles Bulletin: Interest on Security Deposits

This explains how much interest you should pay on security deposits each year between 1990 and 2020 for rental units subject to the Rent Stabilization Ordinance in the City of Los Angeles. Landlords are required to pay (1) simple interest using the rates in this Bulletin, or (2) actual interest earned on security deposit funds deposited in your bank account.

D.1 – AB 1482 Addendum – Exempt from California State Rent Control*

Use this form to amend your existing lease agreement IF YOUR RENTAL UNIT IS EXEMPT FROM STATE RENT CONTROL in order to comply with the California state notice requirement under Assembly Bill 1482, effective July 1, 2020 for new lease agreements and effective August 1, 2020 for existing lease agreements.

D.2 – AB 1482 Addendum – Subject to (not Exempt from) California State Rent Control*

Use this form to amend your existing lease agreement in order to comply with the California state notice requirement under Assembly Bill 1482, effective July 1, 2020 for new lease agreements and effective August 1, 2020 for existing lease agreements.

D.3 – Acknowledgement of Non-Tenancy

Use this form when allowing a resident that is NOT your tenant to live at the premises. This resident is not a party to the lease agreement with your tenant.

D.4 – Addendum to Standard Month-to-Month Rental Agreement / Lease

Use this form to amend or modify a standard “month-to-month” lease to include any terms not covered by the lease or by other forms or addendums we provide.

Use this form when a third-party guarantees your tenant’s lease payments and / or performance under the rental agreement / lease.

D.8 – Disclosure of Information on Lead-Based Paint or Lead-Based Paint Hazards

Use this form if you are aware of any lead-based paint and / or lead based paint hazards in or one the rented premises.

D.9 – Electric Vehicle Charging Station Agreement

Use this form if a tenant wishes to install an electric vehicle charging station at the tenant’s cost.

D.10 – House Rules: Obligations of a Resident, Rules and Regulations Addendum to Lease and Rental Agreement *

Use this form to have a tenant acknowledge tenant obligations and house rules at your property.

D.11 – Lead Booklet

Before renting pre-1978 housing, owners must disclose the presence of known lead-based paint hazards in the housing premises. At the time of lease signing, renters must receive this federally approved pamphlet on lead poisoning prevention.

D.12 – Lease Extension Agreement

Use this form when extending your lease agreement beyond any initial or extended term.

D.13 – Personal Property / Parking / Storage Leasing Agreement

Use this form when leasing a storage area, parking space or other leased property to a tenant separate from the lease of a residential unit.

Use this form when renting a unit to a tenant that has a pet and when you do not have a written lease.

D.16 – Political Sign Addendum

Use this form to set forth the rules for the placement of political signage at a property.

D.17 – Pool and Hot Tub Addendum

Use this form when a pool and/or hot tub is located on the property.

D.18 – Proposition 65 Warning Addendum

Proposition 65 requires warnings to be provided to each known adult occupant of a rental property at the time of renting, leasing, or “hiring out” the property. The warning must be initially made and renewed each year by one of the following methods: (1) delivering a letter to each known adult tenant; (2) sending an electronic message to each known adult tenant’s email address; or (3) including the warning in a lease or rental agreement. In this Addendum, the name of at least one chemical that is a carcinogen and/or reproductive toxicant that is present at the property must be listed. Although landlords are not required to use this addendum and warn residents of the presence of cancer-causing chemicals, use of this form provides a “safe harbor.” Declining to provide the warning may pose a risk of enforcement action, whereby landlords would need to defend their warnings as being “clear and reasonable.” Landlords that fail to provide adequate warnings are subject to penalties as high as $2,500 per violation per day.

D.19 – Special Flood Hazard Area Addendum

Use this form when your rental property is located within a special flood hazard area.

D.20 – Standard Satellite Dish and Antenna Addendum

Use this form when a tenant requests to install a satellite dish and/or antenna at the rental property.

D.21 – Water Submetering Addendum

Use this form to bill a tenant for water service separately from the rent when the premises are equipped with a water submeter.

D.22 – Information on Mold and Dampness for Renters in California

[Spanish Version]

Effective January 1, 2022, the booklet, “Information on Dampness and Mold for Renters in California” from the California Department of Public Health must be provided to renters for all new tenancies. This booklet is required by legislation that was passed in 2001 (Senate Bill 732, the “Toxic Mold Protection Act”) but not developed by the Department of Public Health until recently. It is available in both English and Spanish.

Form A, use this form in conjunction with Forms B & C below. Use this form when it appears a tenant has left property behind in the rental unit or appears to have abandoned the rental unit (e.g., moved out).

E.9 – Notice of Right to Claim Abandoned Property (Valued at Less than $700)

Form B, use this form in conjunction with Forms A & C. Use this form to notify a tenant of any property that was abandoned by tenant that is worth less than $700, and the process for recovering or disposing of the property if not claimed.

E.10 – Notice of Right to Claim Abandoned Property (Valued at More than $700)

Form C, use this form in conjunction with Forms A & B above. Use this form to notify a tenant of any property that was abandoned by tenant that is worth more than $700, and the process for recovering or disposing of the property if not claimed.

E.11 – Notice of Change of Terms in Tenancy (Non-Local Rent Control & State Mandated AB 1482 Rent Control)

Use this form to document any changes in terms under a lease in rental units not subject to a local jurisdiction’s rent control and for units subject to state mandated rent control per Assembly Bill 1482. (e.g., change in rental rate).

E.12 – Notice of Owner / Agent Office Hours

Use this form to notify tenants the days and times you wish to be contacted for non-emergency matters.

E.13 – Reminder: Your Rent is Past Due

Use this form to provide a tenant with a “friendly reminder” when rent is past due. Use this form prior to providing tenant with a “Three Day Notice to Pay or Quit.”

E.14 – Santa Monica Notice of Change in Terms of Tenancy

Use this form to document any changes in terms under a lease in the City of Santa Monica (e.g., change in rental rate).

E.15 – Sixty (60) Day Notice to Quit

Use this form to notice a tenant to return possession of premises within 60-days for specific reasons such as failure to enter into new lease; move-in of owner or the owner’s spouse, children, parents, or resident manager; or for a unit that is not otherwise subject to eviction restrictions.

E.16 – Thirty (30) Day Notice to Quit

Use this form to notice a tenant to return possession of premises within 30-days for specific reasons such as failure to enter into new lease; move-in of owner or the owner’s spouse, children, parents, or resident manager; or for a unit that is not otherwise subject to eviction restrictions.

E.17 – Thirty Days Notice to Pay Dishonored Check

Use this form to notice a tenant to “make good” on a check payment within 30-days.

E.18 – Three Day Notice to Pay or Quit

Use this form to notice a tenant to pay rent within 3-days, or upon failure to do so, to return possession of premises within 3-days.

E.19 – Three Day Notice to Perform or Quit

Use this form to notice a tenant to cease specific behavior or cease performing specific acts within 3-days, such as causing a disturbance or prohibiting owner access to tenant’s unit, or upon failure to do so, to return possession of premises within 3-days.

E.20 – Three Day Notice to Quit

Use this form to notice a tenant for breach or other lease violation that cannot be cured (such as conducting criminal activity or creating a nuisance at premises).

E.21 – West Hollywood Notice of Change in Terms of Tenancy

Use this form to document any changes in terms under a lease in the City of West Hollywood (e.g., change in rental rate).

E.22 – Standard Notice of Right to Request Initial Inspection

Use this form when an initial inspection of the rental unit is requested by a tenant. This form documents the condition of a rental unit at the time possession is first accepted by renter which may then be helpful later when inspecting condition of a rental unit upon move-out and documenting deductions from tenant’s security deposit.

E.23 – Beverly Hills Notice of Change in Terms of Tenancy

E.26 – Sixty (60) Day Notice to Quit (No-Fault Eviction for Use Under A.B. 1482 State Rent Control)

Use this form to provide tenants with the required 60-days’ “notice to quit” in order to evict for a “no-fault” reason under Assembly Bill 1482, the statewide rent control and tenant protection law that went into effect as of January 1, 2020. No-fault eviction include reasons such as owner move-in or substantial remodel. Under Assembly Bill 1482, owners are required to pay tenants one-month of rent either in a direct payment or as a credit to offset rent otherwise due if a tenant has occupied the unit for 12 months or more (or for 24 months or more under certain conditions). Use this form along with a Proof of Service form.

H.24 – Santa Monica: Notice of Residential Leasing Requirements

Santa Monica Municipal Code Chapter 6.22 requires all landlords to provide this notice to all prospective tenants. The City of Santa Monica imposes the following requirements for all residential leases: (i) lease must be in writing and the initial lease term must be no less than one year; (ii) the rental unit must be leased unfurnished; and (iii) tenant must use and occupy the rental housing unit as their primary residence. Landlords are required to provide this notice to their tenants in both English and Spanish – this form is in 2 pages to accommodate both languages. The notice must be provided both when you give your prospective tenant a rental application and when you provide any written lease to be signed. If you are providing the application or lease electronically, the notice must also be provided electronically. Within 60-days of the commencement of the lease, your tenant must provide you with at least two (2) documents to prove the rental unit is their residence (see requirements stated on the notice).

Owners With Fewer Than 26 Employees: Use this form when employing a resident manager at your property and when you offset (credit) the value of the rental unit provided to the resident manager against wages due to the resident manager.

**Note: For employers with fewer than 26, employees, the maximum allowable reduction in rent that can be credited toward the minimum wages owed is $734.21 per month for a single onsite manager and $1,086.07 per month where a couple is employed. Minimum wage in the State of California for employers with fewer than 26 employees is $13.00; however, approximately 35 jurisdictions in California have higher minimum wages, including the City of Los Angeles which is $15.00 per hour for 2021 As of January 1, 2022, minimum wage will increase to $14.00 per hour and then $15.00 per hour as of January 1, 2023 for employers with 25 or fewer employees.

I.11.2 – Standard Resident Manager Employment Agreement (Credit)

Rental housing providers must, once again, serve a new notice from the State of California to all tenants who have missed one or more rental payments. This new notice form must be served by July 31, 2021. For each month thereafter, if tenants do not pay all of their rent due, rental housing providers should continue to serve the new 15-Day Notice for unpaid rent, along with this new, informational notice from the State of California.
**This notice must be provided to tenants who as of JULY 1, 2021 had not paid one or more rent payments between MARCH 1, 2020 and THEREAFTER and such rent amounts are still due and owing. This notice must be provided to all such tenants on or before JULY 31, 2021.**

In addition, this Notice should be provided to tenants who do not pay rent due for any monthly periods between July 1, 2021 and September 30, 2021.
