The coming week marks the anniversary of a tragic event that sparked California’s new Balcony Law, which will have significant impacts on the multifamily housing industry for many years to come.  In June 2015, a balcony on a an apartment building near U.C. Berkeley collapsed.  Six people died and seven others were seriously injured when the balcony gave way.

Investigation of the tragedy showed the balcony’s wood framing was weakened by dry rot from rain leaking through the seal of the main building causing the critical load-bearing support to collapse.  Following this event, the State of California adopted a Balcony Inspection Law applicable to multifamily rental properties, Senate Bill 721, that requires inspections and repairs of balconies and other “exterior elevated elements” such as decks, walkways, and stairways on apartment buildings with three or more units.  The deadline for inspection reports is 2025 and every six years thereafter.
