L.A. County Prohibition on Eviction Based on Non-Payment of Rent Reinstated as of July 1st

At the June 28th Los Angeles County Board of Supervisors Meeting, a proposal advanced by Supervisor Barger was approved by the Board with amendments made by Supervisor Kuehl. The approved proposal calls for the County to identify “existing state programs or funding available to landlords/rental property owners who have been impacted by the pandemic and any proposed programs/legislation designed to provide support to property owners and their tenants.” The amended proposal also directs County staff to report to the Board in 30 days with the status of litigation challenging the County’s moratoriums and recommendations on whether the Board should consider phasing out the moratoriums earlier.

Supervisor Barger’s motion is of particular importance at this time because beginning on July 1st the Countywide eviction moratorium will reinstate prohibitions on evictions based on non-payment of rent due to COVID-19 financial hardship, as described below.  With the State’s Rent Relief program closed since March 31, 2022, rental housing providers do not have any means to obtain financial support if renters do not pay rent beginning July 1st.

Supervisor Barger has long advocated for the County to bring financial relief to property owners and was the only no vote in January when the Board of Supervisors adopted the current Countywide eviction moratorium and rent increase freeze which applies only to the County’s unincorporated areas through the end of 2022, with some eviction prohibitions to potentially remain in effect through June 30, 2023.

The Association has continuously strongly advocated for the County’s moratoriums to end and for the rental housing industry to resume pre-pandemic operations similar to all other industries.  We will continue to monitor this matter closely, advocate for our members interests and provide updates.

Summary of Moratorium Provisions:

The moratoriums are currently in Phase 2 (June 1, 2022 through December 31, 2022).

Eviction Moratorium (Countywide)

  • Reinstatement, effective as of July 1, 2022, of the prohibition on evictions for non-payment of rent due to COVID-19 financial hardships for households with an income at or below 80% of the Area Median Income (AMI) determined based on self-certification provided by the renter. This applies to rent due on or after July 1st.
  • Maintains eviction prohibitions for:
    • No-fault reasons, with limited exceptions for owner move-in
    • Nuisance
    • Unauthorized occupants or pets
  • Maintains renter anti-harassment and retaliation protections

Rent Increase Freeze (Rent Stabilized Units in L.A. County’s Unincorporated Areas Only)

The broad prohibition on all rent increases, new pass-throughs, or charges, regardless of whether or not the renter is financially impacted by COVID-19 remains in effect. This prohibition applies to all units subject to the Los Angeles County’s Rent Stabilization Ordinance (for unincorporated areas).
