The City of Los Angeles recently passed several tenant protection ordinances that impact all providers of residential rental housing in the city, whether subject to the City's rent stabilization ordinance or exempt from it. Ordinance No. 187763 requires a financial threshold of past due rent (equal to one month's fair market rent) be met prior to initiating eviction proceedings. Ordinance No. 187764 requires rental housing providers to pay substantial penalties should a rent increase on housing legally exempt from either local or state rent stabilization rules exceed a specified percentage (for 2023, the threshold is 10%). There are also new just cause eviction protections for non-RSO tenants, and new notice requirements.

LAHD oversees the City's Systematic Code Enforcement Program (SCEP). Under the program, LAHD housing inspectors conduct site visits to all Los Angeles rental income properties with two or more units on a three-year revolving basis. (There are approximately 96,000 properties and 740,000 rent-controlled units in the city). Recently, Los Angeles has hired more inspectors. Property owners have expressed concern that new inspectors tend to cite more issues than are necessary to address safety concerns. Common issues cited include lack of proper maintenance and unsanitary conditions, broken windows, illegal units, defective or improperly installed smoke detectors, and lack of required lighting or ventilation. SCEP was created in 1998 to ensure that the Los Angeles rental housing stock is safe and habitable.

Anna Ortega is the Assistant General Manager of the Regulatory Code and Compliance Bureau for the Los Angeles Housing Department, responsible for management of citywide major operations for the Rent Stabilization, Code Enforcement, and Compliance Divisions. Anna will be joined by Robert Galardi – Director, Head of Code Enforcement, and Michael Prendergast – Head of Finance.

The Rent Stabilization Division enforces the Los Angeles Rent Stabilization Ordinance (RSO) that seeks to balance the interests of landlords and tenants by regulating the registration of rental units, allowable rent increases, evictions, and relocation assistance. The Code Enforcement Division maintains the habitability of the City's 860,000 multi-family rental units by enforcing housing code regulations. The Compliance Division administers the Rent Escrow Account (REAP) and Utility Maintenance Programs (UMP), conducts public hearings, prepares legal cases for the Office of the City Attorney, and operates billing and collections for program fees. Bureau staff also provide year-round informational workshops for landlords and tenants.

Moderator:

Harold Greenberg, Esq. (Director and Past President of AAGLA). Harold Greenberg is an attorney practicing real estate law in Los Angeles. He graduated Summa Cum Laude and Phi Beta Kappa from Pennsylvania State University and served as a Lieutenant in the U.S. Army Military Police. He earned his J.D. from Temple University Law School and has held numerous legal roles including Judge Advocate in the General's Corps., Deputy Public Defender, and District Attorney for Los Angeles County. He has also taught at California State University, Glendale University College of Law, and lectured at USC. Mr. Greenberg is admitted to the state bars in California and Pennsylvania and is licensed to practice before several federal courts including the U.S. Supreme Court. He previously chaired the State Bar Committee on Landlord/Tenant Rights and served as AAGLA President.
