Legal Compliance Challenge: Keeping Up with Complex Housing Regulations

Thriving under California’s complex housing regulatory environment requires staying up to date and strict adherence to things like state and local rent caps, complicated just-cause eviction rules and tenant protections, and habitability standards (e.g., pests, mold, leaks, etc.). Our guest and legal expert, Eileen Kendall, managing partner of Kendall Law, will provide her unique, strategic advice on preventative measures to avoid lawsuits and help housing providers quickly regain possession of their residential rental properties. For those of us who are self-managing the properties we own under California’s complex legal and regulatory environment, we face some of the most challenging rules and regulations, and failure to strictly comply can often be detrimental due to high risk of lawsuits, fines for unintended (or perhaps intended) violations, and legal liabilities due to improper maintenance, habitability issues, etc. Just a few of the complex regulations faced by housing providers include:

  • Complex Legal Landscape: California laws, such as the Tenant Protection Act, are heavily pro-tenant, with strict regulations regarding security deposits, habitability, and eviction procedures.
  • High Legal Liability: Failure to properly maintain the property (e.g., plumbing, roof, pests) can lead to lawsuits or tenants withholding rent. Often, habitability claims are not covered by insurance!
  • Discrimination Risks: Accidental violations of fair housing laws during tenant selection can result in significant legal consequences.
  • Eviction Errors: Incorrectly handling evictions can lead to long delays and costly penalties. Never mind the lost rent!

To survive and ultimately thrive in today’s regulatory environment, it is important for property owners to stay up to date and regularly review resources from the Apartment Association of Greater Los Angeles regarding new laws, rent limits, maintaining housing conditions, and landlord rights. Today’s housing providers must also maintain a regular schedule for inspections and ongoing maintenance to address and repair hazards promptly. For some, property management may have proven far too difficult, and they may wish to consider hiring professionals who are experts in state and local regulations to prevent legal issues.

Janet M. Gagnon, Esq., has more than 20 years’ experience in government affairs at the local, state, and federal levels.  She has represented several large membership-based associations, including the Apartment Association of Greater Los Angeles, California Realtor Association and Alzheimer’s Association Southern California chapter. In addition, she has worked as an in-house lobbyist for many national private companies on issues including healthcare, renewable energy, and technology.
